The State of California does not require
licensing for In-Home Non-Medical Care
Agencies. Additionally, unlike several states,
the State of California does not have a legal
provision requiring all skilled or unskilled
caregivers providing private duty
services to senior patients or clients to
submit to a criminal background check.
Despite the lack of licensing and background
check requirements, there are several
methods to evaluate and verify a personal
care service agency's quality of service,
dependability and trustworthiness.
Better Business Bureau
One of the best sources of information to
consult when checking out an in-home non-medical care agency is the Better Business Bureau
(BBB) database. The BBB maintains a very thorough record index on both members and
non-member businesses. If an in-home care agency is a BBB-accredited member, you can be
confident that agency went through a comprehensive screening process before becoming
BBB-accredited. Non-accredited businesses can also be found in the BBB reference guides.
Any business profile will have a ranking (or simply be classified as "Not Ranked"); history of
customer complaints (if any); and a status report of when and how those complaints were
resolved. An in-home care agency's length of time in operation along with ownership and
contact information is also on display.
Criminal History Checks
As mentioned earlier, in-home non-medical caregivers are not required by the State of
California to submit to a criminal background check. In spite of this lack of mandate, there are
some State of California regulations which present strong incentives for in-home care agencies
to require their caregivers to submit to a criminal history check.
California Health & Safety Code 1569.17 requires all persons working at a Residential Care
Facility for the Elderly (RCFE) to obtain a current criminal history clearance. Although one of
the exemptions to this regulation are "third-party contractors retained by a resident", which are
often non-medical caregivers, the code also emphasizes that licensees (RCFE's) are not
prohibited from requiring criminal background checks for all exempt individuals who have
contact with facility residents.
Most California RCFE's take advantage of this tacit authorization and as a matter of policy
require criminal background checks on all outside contractors and service providers who come
in contact with their residents. Many in-home non-medical care agencies receive a significant
portion of their business from clients in RCFE's; therefore, most non-medical care agencies
require criminal background checks for their caregivers as part of their commitment to the care
and safety of their clients and to conform to RCFE policies.
In states not requiring licensing of in-home non-medical care agencies, a good reference point
for agency evaluation can often be an industry association. In California, the premier home
care industry association is the California Association for Health Services at Home (CAHSAH).
The CAHSAH promotes quality home care by providing its members with advocacy, education
and core value standards (including a Code of Ethics) which the service agency members can
integrate into the way they manage their business and dispense services to clients and patients.
One of the CAHSAH membership categories is for Private Duty and Home Care Aide
organizations, which provide home management and non-medical services for clients at their
places of residence.
If a non-medical in-home care agency is a CAHSAH member, the chances are good that their
business practices and quality of service are tailored after the professional standards endorsed
by the CAHSAH. The CAHSAH website offers lists of qualified member agencies all over the
